Using the CT Website

  1. Access and use by you of the Competition Tribunal website (the “CT Website”) constitutes unconditional acceptance by you of these terms and conditions as the same may be modified and/or supplemented from time to time in accordance with these terms and conditions.
  2. The CT Website is maintained for your personal use and viewing. You agree that your use of the CT Website is for lawful purposes only. You agree that you will not use the CT Website for any unlawful purpose.
  3. The CT Website is best viewed with the latest version of browsers, namely Microsoft Edge, Mozilla Firefox, Safari or Google Chrome.
  4. To view and print the documents which are in Portable Document Format (PDF), please download the latest version of the Adobe Acrobat Reader software.

Intellectual property rights

  1. Unless otherwise indicated, all materials found on the CT Website are subject to intellectual property rights owned by the Government of the Hong Kong Special Administrative Region (the “Government”). Prior written permission of the Government is required if you intend to reproduce, make available to the public, adapt, distribute or otherwise use any Government intellectual property rights protected material found on the CT Website, in whole or in part, in any way other than that permitted in Paragraph 6 below, or for any purpose other than that permitted in Paragraph 6 below. To obtain the requisite permission, please contact Senior Judicial Clerk I, Competition Tribunal.
  2. Apart from material that is subject to the intellectual property rights of a party other than the Government, and unless otherwise specified, and subject to Paragraph 15 below, you may reproduce materials found on the CT Website protected by the intellectual property rights of Government, in whole or in part, for personal use, in any format, without charge or further permission, subject to the following conditions:
    1. such material must be reproduced accurately and must not be used in a manner adversely affecting the moral rights of the Government; and
    2. the source of such material must be identified and the Government must be acknowledged as the intellectual property rights owner of such material. The Government reserves the right to withdraw any such permission at any time without any prior notice.
  3. Some of the material found on the CT Website may be subject to the intellectual property rights of a party other than the Government. Authorisation to reproduce, make available to the public, adapt, distribute or otherwise use any such material must be obtained from the relevant intellectual property rights owner.

  6. Emails should be used solely for making general enquiries and should not contain personal data or information pertaining to a particular court case. Emails received may be re-directed to the office or registry concerned for reply.
  7. External links included on the CT Website are for users’ convenience only. Users acknowledge that when clicking a link to an external website, they are leaving the CT Website and are subject to the terms and conditions, privacy and security policies of the owners or sponsors of the external website. The Government is not responsible for the contents or reliability of the linked websites and does not necessarily endorse the views expressed within them. We cannot guarantee that these links will work all of the time and we have no control over the availability of the linked pages. No express or implied warranty, representation or statement is made or given by the Government as to the accuracy, fitness for any particular purpose, non-infringement, reliability, security, updatedness or freedom from computer virus in relation to the contents of the linked websites. Hyperlinking to the CT Website

  1. Prior consent of the Government is not required for linking to the CT Website, except loading the material found on the CT Website into frame(s) on your website (i.e. the contents of the CT Website being viewed via hyperlinking as part of the website), provided that your website must not present the material of the CT Website as your own or otherwise misrepresent the material of the CT Website, or misinform any users about the origin or ownership of the material of the CT Website.
    1. The permission given in Paragraph 15 above only applies to material found on the CT Website protected by the intellectual property rights of the Government. The Government reserves the right to withdraw any permission given in Paragraph 15 above at any time without any prior notice.
    2. For the avoidance of doubt, the permission to build hyperlink(s) to the CT Website does not extend to any other websites linked to the CT Website or any material on the CT Website the intellectual property right of which belongs to a third party. Authorisation to build hyperlink(s) to such websites or material must be obtained from the relevant intellectual property rights owners.
    3. The Government does not permit a website to hyperlink to the CT Website if it contains any material which is libellous, defamatory, pornographic, obscene, or is in any way in breach of the laws of the Hong Kong Special Administrative Region or infringes any intellectual property rights (including but not limited to copyright) and moral rights. The Government may, in its sole discretion, require any websites to remove any hyperlink to the CT Website at any time.

Social Media

  1. We reserve the right to remove or edit all posts and comments on our social media without any prior notice.

Indemnity

  1. You agree to indemnify the Government against any loss, damage, costs, liabilities and expenses incurred by the Government in relation to claims or disputes which arise from your use of the CT Website or the information or material contained on the CT Website.

Variation

  1. We may modify, suspend or discontinue any information or features on the CT Website at any time, with or without notice, and without liability.
  2. We may modify and/or supplement these terms and conditions at any time and from time to time without any prior notice. You should visit this page from time to time for the then current terms and conditions.

Language

  1. These terms and conditions have been translated into Chinese. If there is any inconsistency or ambiguity between the English version and the Chinese version, the English version shall prevail.

Choice of Law and Jurisdiction

  1. These terms and conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
